Terms governing use of cosm.org

These Terms of Use (“Terms”) govern your access to and use of cosm.org and other webpages that link to these Terms (collectively, the “Site”).
The Site is operated for the Chapel of Sacred Mirrors (“CoSM,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
Additional terms may apply to donations, tickets, memberships, events, accommodations, purchases, contests, submissions, or other services. If additional terms conflict with these Terms, the additional terms control for the applicable service.
1. Informational and Marketing Site
The Site provides information about CoSM, its mission, location, art, exhibitions, events, programs, workshops, membership, fundraising, and related activities.
Site content is provided for general informational and promotional purposes. Although we try to keep it accurate and current, information may occasionally be incomplete, outdated, or incorrect.
Event schedules, operating hours, admission requirements, prices, availability, participants, exhibitions, and program details may change. Please confirm time-sensitive information before traveling or making arrangements.
Nothing on the Site constitutes legal, financial, tax, medical, mental-health, spiritual, or other professional advice.
2. Eligibility
You may use the Site only if you can legally agree to these Terms. If you are under the age of legal majority where you live, you may use the Site only with the involvement and permission of a parent or legal guardian.
3. Permitted Use
You may use the Site for lawful, personal, and noncommercial purposes, including learning about CoSM and accessing information about its programs.
You may not:
Violate any applicable law or another person’s rights;
Use the Site for fraud, harassment, abuse, or unlawful activity;
Attempt to gain unauthorized access to the Site or related systems;
Interfere with the operation, availability, or security of the Site;
Introduce malicious software or harmful code;
Circumvent security or access controls;
Scrape, crawl, harvest, or extract Site content through automated means in a manner that burdens the Site or violates applicable law;
Collect personal information about others without authorization;
Impersonate another person or misrepresent your affiliation with CoSM;
Use Site content to train or develop an automated system where doing so infringes CoSM’s or another party’s rights;
Remove copyright, trademark, attribution, or proprietary notices; or
Use the Site or its content for commercial exploitation without written permission.
Ordinary use of public search engines and accessibility tools is permitted.
4. Intellectual Property
The Site and its contents—including artwork images, photographs, videos, graphics, logos, names, text, designs, audio, software, and their arrangement—are owned by CoSM, contributing artists, licensors, or other rights holders and are protected by intellectual-property laws.
Your access to the Site does not transfer ownership of any content or grant a license except the limited permission necessary to view and use the Site in accordance with these Terms.
Unless CoSM or the applicable rights holder gives prior written permission, you may not reproduce, distribute, publish, publicly display, publicly perform, modify, license, sell, create derivative works from, or commercially exploit Site content.
The presence of artwork on the Site does not mean that the work is in the public domain or available for reuse. Rights in individual works may belong to the artist or another rights holder.
“CoSM,” “Chapel of Sacred Mirrors,” related logos, and other source identifiers may be trademarks or service marks. You may not use them in a manner likely to create confusion concerning sponsorship, affiliation, or endorsement.
5. Requests to Use Content
To request permission to reproduce or otherwise use Site content, contact CoSM and identify:
The material you wish to use;
The proposed use;
The format and distribution;
Whether the use is commercial; and
Your contact information.
CoSM cannot grant rights that belong to an independent artist, photographer, publisher, or other third party.
6. User Communications and Submissions
If you send us comments, questions, suggestions, or other materials, you represent that:
You have the right to provide them;
They do not infringe another person’s rights;
They are not unlawful, fraudulent, threatening, or malicious; and
They do not contain harmful code.
You retain ownership of original material you submit. You grant CoSM a nonexclusive, worldwide, royalty-free license to use, reproduce, and adapt the submission as reasonably necessary to respond to you, operate the Site, fulfill your request, and administer the applicable program.
This license does not authorize CoSM to publicly promote your personal story, artwork, photograph, or testimonial without any additional permission required by law.
Do not send unsolicited confidential business proposals, sensitive personal information, or material you expect us to keep confidential unless we have agreed otherwise in writing.
7. Donations, Tickets, Memberships, and Purchases
The Site may link to services through which visitors can make donations, purchase tickets or memberships, register for events, or buy merchandise.
Those transactions may be processed by independent platforms and may be governed by separate terms, refund or cancellation policies, privacy policies, and payment conditions.
Unless expressly stated otherwise:
Availability is not guaranteed until a transaction is confirmed;
Event details and participants may change;
Refunds, exchanges, recurring payments, and cancellations are governed by the terms presented during the transaction;
Tax treatment depends on individual circumstances; and
No statement on the Site is tax or financial advice.
Consult a qualified adviser regarding the deductibility or other tax consequences of a contribution.
The CoSM Shop is a separate online service and has its own transaction terms and policies.
8. Third-Party Links and Services
The Site may link to or embed content from third-party services. CoSM does not control independent third-party websites and is not responsible for their availability, accuracy, security, content, products, policies, or practices.
Your use of a third-party service is governed by the terms between you and that provider. A link or integration does not necessarily constitute an endorsement.
9. Copyright Concerns
If you believe material on the Site infringes your copyright, send a written notice to CoSM containing:
Identification of the copyrighted work;
Identification and location of the allegedly infringing material;
Your contact information;
A statement that you have a good-faith belief that the use is not authorized;
A statement, made under penalty of perjury, that the notice is accurate and that you are authorized to act for the rights holder; and
Your physical or electronic signature.
Notices should be sent to the contact information in Section 16. Knowingly submitting a materially false infringement notice may result in liability.
10. Privacy
Our Privacy Policy explains how we handle information associated with the Site and is incorporated into these Terms by reference.
11. Site Availability and Changes
We may modify, suspend, restrict, or discontinue any portion of the Site at any time. We do not guarantee that the Site or any particular content will always be available, uninterrupted, current, or error-free.
We may correct errors and update Site content without notice.
12. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
CoSM disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. CoSM does not warrant that the Site will be uninterrupted, secure, error-free, or free of harmful components, or that its content will be complete or accurate.
Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CoSM AND ITS AFFILIATED ORGANIZATIONS, DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, CONTRACTORS, REPRESENTATIVES, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE SITE.
TO THE FULLEST EXTENT PERMITTED BY LAW, CoSM’S TOTAL LIABILITY FOR CLAIMS ARISING FROM OR RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
These limitations do not apply to liability that cannot lawfully be excluded or limited.
14. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless CoSM and its affiliated organizations, directors, officers, employees, volunteers, contractors, and representatives from claims, liabilities, damages, losses, and reasonable costs arising from:
Your unlawful or unauthorized use of the Site;
Your material violation of these Terms; or
Content you submit that infringes another party’s rights.
This obligation does not apply to the extent a claim results from CoSM’s own unlawful conduct.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
Subject to any rights you have under applicable consumer law, legal proceedings arising from these Terms or the Site must be brought in a state or federal court with jurisdiction in Dutchess County, New York. You and CoSM consent to the jurisdiction of those courts.
Before filing a claim, the parties are encouraged to contact one another and attempt in good faith to resolve the matter informally.

17. Changes to These Terms
We may revise these Terms periodically. Revised Terms become effective when posted unless a later date is stated.
Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
18. General Provisions
If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain effective.
Our failure to enforce a provision is not a waiver. These Terms and any applicable additional terms constitute the agreement between you and CoSM regarding the Site.
